The Vatican-Lutheran Joint Declaration on Justification was null since the Catholic side rejected the dogma extra ecclesiam nulla salus(EENS) by wrongly re-interpreting Vatican Council II as a rupture with EENS.Vatican Council II was wrongly interpreted by assuming hypothetical cases were non hypothetical, so theoretical references like LG 16, LG 8, UR 3, NA 2 etc were considered non theoretical, but  explicit and personally known.People saved outside the Church.

Without this irrationality, Vatican Council II, without the premise would not contradict the dogma EENS which mentions Protestants, Lutherans( heretics) as going to the fires of Hell, unless they enter the Church as members(Cantate Dominino, Council of Florence 1441).
Cardinal Ratzinger/Pope Benedict had interpreted Vatican Council II with a hermeneutic of rupture.Since for him there was known salvation outside the Church. The baptism of desire, baptism of blood and being saved in invincible ignorance referred to visible people who were saved outside the Church. So Pope Benedict rejected the dogma EENS making the Declaration null for Catholics.
According to EENS( premise-free) and Vatican Council II( premise-free) Lutherans are on the way to Hell. They do not have justification or sanctifying grace. They are outside the Mystical Body of Christ.-Lionel Andrades
