Akin believes he can refute the Open Letter and rescue Pope Francis from the charge of heresy by way of technicality, noting that “heresy” is defined in the Code of Canon Law as the obstinate rejection of a dogma defined by the Church as divinely revealed, that is, as a part of the deposit of faith left to the Church by Christ and the apostles. Akin then observes that none of the texts cited by the open letter as being contradicted by Pope Francis are shown by the letter to be defined in this way, ergo there is no heresy demonstrated. -Matthew Cullinan Hoffman

1.Since hypothetical cases of the baptism of desire, baptism of blood and being saved in invincible ignorance are non hypothetical and so they become practical exceptions to the dogma EENS.The result is a rupture to EENS. It is assumed wrongly that there is salvation outside the Church and it is known in personal cases. So EENS is put aside or there is a new version. 
2.Since there is known salvation outside the Church and the dogma EENS is obsolete with known cases of the BOD, BOB and I.I, the Athanasius Creed which says outside the Church there is no salvation, is made redundant too.More heresy.
3.Since there is known salvation outside the Church the Nicene Creed is re-interpreted as 'I believe in three or more known baptisms, desire, blood and ignorance outside the Church and they exclude the baptism of water in the Catholic Church".More heresy.It is also official and part of the Profession of Faith.
4.So the Apostles Creed really means that we believe in the Holy Catholic and Apostolic Church, we believe in the Holy Spirit which teachs the Catholic Church today that outside the Church there is known salvation and so all do not necessarily need to enter the Catholic Church for salvation.
